These Terms and Conditions (the "Terms") govern your access to and use of www.dkmafragrances.com (the "Site"), including purchases of products and services offered through the Site.
The Site is owned and operated by DKMA Fragrances LLC. Throughout these Terms, "DKMA Fragrances," "DKMA," "we," "us," and "our" refer to DKMA Fragrances LLC.
By accessing or using the Site, creating an account, or placing an order, you indicate that you have read, understand, and agree to these Terms and any policies referenced within them. If you do not agree to these Terms, please do not use the Site.
These Terms contain a dispute resolution provision that may affect how disputes between you and DKMA Fragrances are resolved. Please review that section carefully.
Effective Date: July 1st, 2026
By using the Site or placing an order, you represent that you are legally able to enter into a binding agreement in your jurisdiction.
If you are under the age of majority where you live, you may use the Site only with the involvement and permission of a parent or legal guardian.
All content published or made available through the Site is the property of DKMA Fragrances LLC, the Site's creators, or applicable content licensors.
This includes, without limitation, DKMA Fragrances names, fragrance names, Expression names, logos, branding, product descriptions, fragrance concepts, text, photography, graphics, artwork, designs, documents, downloadable materials, website elements, and other content that contributes to the composition of the Site.
For the avoidance of doubt, this also includes all proprietary fragrance formulations, accords, and scent structures, whether pre-existing, independently developed by DKMA Fragrances, or created, refined, or modified through collaboration, consultation, or input provided by customers, including in connection with bespoke fragrance services. Any such formulations, including those developed in response to customer preferences, briefs, or feedback, remain the exclusive intellectual property of DKMA Fragrances LLC and are protected as trade secrets and/or proprietary works to the fullest extent permitted by law.
Except as expressly permitted by DKMA Fragrances or applicable law, Site content may not be copied, reproduced, republished, distributed, modified, sold, commercially exploited, or used to create derivative works without prior written permission.
Purchase of any product or service, including bespoke fragrance creation services, does not confer upon the customer any ownership interest, license, or other rights in or to any fragrance formulation, recipe, accord, or underlying composition, nor does it grant the right to reproduce, reverse engineer, or commercially replicate any DKMA Fragrances product or scent.
Nothing in these Terms transfers ownership of DKMA Fragrances intellectual property to you.
You agree to use the Site only for lawful purposes.
You may not use the Site to:

Engage in fraudulent, deceptive, unlawful, or unauthorized activity

Harass, abuse, threaten, defame, or mistreat another person

Violate the rights of another user, DKMA Fragrances, or any third party

Infringe intellectual property, privacy, publicity, or other legal rights

Access or attempt to access another user's account without authorization

Submit false, misleading, or fraudulent information

Introduce viruses, malicious code, or other technology intended to interfere with the Site

Attempt to bypass, disable, or interfere with security features of the Site

Collect or misuse personal information belonging to others

Use automated methods to scrape, crawl, harvest, or extract Site content for an unauthorized commercial purpose

Interfere with the operation, security, or availability of the Site

Use the Site or its content in any way that violates applicable law
If we reasonably believe that you are using the Site illegally, fraudulently, or in violation of these Terms, we reserve the right to limit, suspend, or terminate your access and to take other appropriate action.
When you create an account on the Site, you agree that:

We reserve the right to suspend or terminate an account that is used illegally, fraudulently, or in violation of these Terms.
These Terms govern products and services made available through the Site.
Products offered by DKMA Fragrances include fragrances and related fragrance products displayed on the Site from time to time.
Services offered through the Site include Bespoke Scent Creation and any other services specifically identified by DKMA Fragrances.
Product and service availability may change without notice. A product displayed on the Site may become unavailable before an order is completed or fulfilled.
We make reasonable efforts to present our products, packaging, colors, sizes, fragrance descriptions, and other information accurately.
However, appearance may vary depending on lighting, photography, screen settings, packaging updates, production variations, or other factors.
Fragrance is also inherently subjective. Descriptions of scent, mood, texture, atmosphere, projection, longevity, or perceived notes are intended to help communicate the character of a fragrance and are not a guarantee that every person will experience the fragrance in the same way.
Bespoke Scent Creation is a personalized service developed through consultation and collaboration with DKMA Fragrances.
Payment for the service is due in full after the Bespoke Scent Design Form has been reviewed and the initial consultation has taken place, unless otherwise stated in writing.
Because bespoke services and resulting fragrances are created specifically for the individual customer or project, services sold through the Site are non-refundable, and bespoke fragrances are not eligible for standard returns or exchanges except where required by law or where DKMA Fragrances determines that an error, defect, or other qualifying issue has occurred.
Additional terms presented as part of the bespoke design process may also apply to that service.
All prices displayed on the Site are subject to change without notice.
Promotions, discounts, complimentary gifts, loyalty offers, shipping promotions, and other incentives may be subject to separate eligibility requirements, expiration dates, exclusions, or additional terms.
Unless otherwise stated, discounts and promotions cannot be applied retroactively to previously completed purchases.
We reserve the right to:

Modify or discontinue products or services

Limit quantities available for purchase

Correct pricing or product information

Refuse, modify, or cancel an order when reasonably necessary
Nothing on the Site requires DKMA Fragrances to continue offering a particular product, fragrance, format, size, service, promotion, or price indefinitely.
We reserve the right to accept, decline, modify, or cancel an order when reasonably necessary, including in circumstances involving:

Payment authorization issues

Suspected fraud or unauthorized transactions

Unusually large quantities

Suspected unauthorized resale or commercial distribution

We may limit quantities purchased by one customer, household, account, payment method, billing address, or shipping address when reasonably necessary.
If DKMA Fragrances cancels an order after payment has been processed, we will issue a refund for the amount collected for the cancelled portion of the order.
If we need additional information to process an order, we may contact you using the information provided at checkout.
If you need to cancel or change an order, contact us as soon as possible. Once an order has entered processing, fulfillment, or carrier possession, we cannot guarantee that a change or cancellation can be made.
Separately placed orders are not guaranteed to be combined for shipment.
We accept the payment methods displayed at checkout, including supported credit and debit cards.
By providing payment information, you represent that you are authorized to use the selected payment method and authorize DKMA Fragrances and its payment-processing providers to charge the amount due for your transaction.
You agree to provide current, complete, and accurate billing and purchase information.
If we reasonably believe that a payment or transaction is fraudulent, unauthorized, unlawful, or otherwise violates these Terms, we reserve the right to decline, cancel, or reverse the transaction as permitted by law.
Payment information may be processed by third-party payment providers subject to their own terms and privacy practices.
Occasionally, the Site may contain typographical errors, inaccurate information, omissions, or outdated information relating to products, descriptions, pricing, promotions, availability, shipping charges, processing times, or other Site content.
We reserve the right to correct errors or update information when discovered and, when reasonably necessary, modify or cancel an affected order.
If we cancel an order because of an error after payment has been collected, the applicable amount will be refunded.
We are not obligated to update every piece of Site content immediately after a change occurs except where required by law.
Orders are shipped according to the shipping methods available for the applicable product and destination.
Eligible U.S. orders may be shipped through an approved ground carrier, including USPS, UPS, FedEx, or another carrier selected by DKMA Fragrances based on destination, product type, and carrier availability.
Local delivery may be offered within approved delivery areas when available.
DKMA Fragrances may also offer complimentary or promotional standard shipping on qualifying purchases.
Our current processing timeframe is displayed on the Site. Processing time refers to the time DKMA Fragrances requires to prepare an order before it is transferred to the shipping carrier and does not include carrier transit time.
Because many fragrance products contain alcohol or other regulated materials, certain shipping services or destinations may be unavailable.
At this time, DKMA Fragrances does not offer international shipping. Our Shipping & Delivery policy will be updated when international shipping becomes available.
You are responsible for providing a complete and accurate delivery address, including the recipient's name and any apartment, suite, unit, or other information required for delivery.
DKMA Fragrances is not responsible for a package being delivered incorrectly because inaccurate or incomplete shipping information was provided with the order.
Shipping methods, carrier estimates, address corrections, delayed packages, packages marked delivered, rush processing, and other fulfillment matters are addressed in greater detail in our Shipping & Delivery Policy, available on the Site.
Unless a product is excluded from return eligibility, unopened and unused products purchased directly from DKMA Fragrances may be returned within 30 days of delivery, subject to the requirements in our Returns & Exchanges Policy.

Certain full-size fragrances may also qualify for DKMA Fragrances' one-time Scent Confidence Exchange under the eligibility requirements stated in our Returns & Exchanges Policy.
Opened fragrances are not eligible for a refund unless the product arrived damaged, defective, or incorrect.
The following are final sale and are not eligible for standard returns or exchanges unless they arrive damaged, defective, or incorrect or applicable law requires otherwise:

Products purchased from another retailer, marketplace, event, or third party must be returned through the original place of purchase and are subject to that seller's policies.
All services sold through the Site are non-refundable unless otherwise expressly stated by DKMA Fragrances or required by law.
Return authorization, return shipping, promotional gifts, damaged or incorrect products, and other return procedures are addressed in our Returns & Exchanges Policy, which forms part of the terms applicable to purchases through the Site.
If an order arrives damaged, defective, missing an item, or contains an incorrect item, please contact DKMA Fragrances within 3 days of delivery.
We may request your order number, a description of the issue, and photographs of the product, package, or shipping materials as appropriate.
Please retain the product and original packaging until the issue has been reviewed.
Depending on the circumstances and product availability, DKMA Fragrances may resolve an eligible issue through a replacement, exchange, store credit, refund, or another appropriate solution.
Promotions are subject to any additional terms presented with the applicable offer.
If a purchase qualifies for a complimentary gift or promotional item and returning part of the purchase would make the original order ineligible for that promotion, the promotional item may also need to be returned.
If a required promotional item is not returned, its listed retail value may be deducted from an otherwise eligible refund.
Refunds on discounted purchases are based on the amount actually paid for the applicable item and will not exceed the original purchase amount.
The Site may use or provide access to services, tools, integrations, payment processors, shipping providers, social platforms, or websites operated by third parties.
DKMA Fragrances does not control every third-party service or website and is not responsible for its independent content, availability, security, privacy practices, or business practices.
Your use of a third-party service may be subject to additional terms established by that provider.
Links to third-party websites are provided for convenience or informational purposes and do not necessarily constitute an endorsement by DKMA Fragrances.
You may have opportunities to submit reviews, comments, photographs, feedback, questions, or other content through the Site or directly to DKMA Fragrances.
You are responsible for ensuring that content you submit does not violate applicable law or the rights of another person.
Content submitted specifically for public posting, such as a product review, may be displayed, reproduced, reformatted, or shared by DKMA Fragrances in connection with our Site, products, marketing, or customer experience, subject to applicable law.
This provision does not mean that personal information, private correspondence, or information submitted through the Bespoke Scent Design process will automatically be made public. The handling of personal information is subject to our Privacy Policy and any additional commitments communicated as part of the applicable service.
We reserve the right to decline, moderate, or remove public-facing content that is unlawful, fraudulent, abusive, infringing, misleading, or otherwise inappropriate for the Site.
The collection, use, and handling of personal information through the Site is governed by the DKMA Fragrances Privacy Policy, available on the Site.
Please review that policy for information about how personal information is collected, used, stored, or otherwise handled.
We work to keep the Site accurate, available, and functioning properly, but uninterrupted access cannot be guaranteed.
The Site may occasionally be unavailable because of maintenance, updates, technical issues, service-provider interruptions, security concerns, or circumstances outside our control.
We may update, suspend, modify, or discontinue portions of the Site or its features when reasonably necessary.
To the fullest extent permitted by applicable law, the Site and its informational content are provided on an "as available" basis.
We do not guarantee that the Site will always be uninterrupted, error-free, completely secure, or free from technical defects.
Nothing in this section excludes any warranty, right, or remedy that cannot legally be excluded or limited.
Where consumer protection legislation or another mandatory law applies and cannot be excluded or limited by agreement, these Terms will not limit the rights or remedies provided to you by that law.
These Terms will be interpreted subject to applicable mandatory legal requirements. If a provision of these Terms conflicts with a mandatory legal requirement, the mandatory requirement will apply to the extent of that conflict.
To the fullest extent permitted by applicable law, DKMA Fragrances LLC and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for actions, claims, losses, damages, liabilities, or expenses, including reasonable legal fees, arising solely from your use or misuse of the Site.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
Except where prohibited by law, by using the Site you agree to indemnify and hold harmless DKMA Fragrances LLC and our directors, officers, agents, employees, subsidiaries, and affiliates from actions, claims, losses, damages, liabilities, and expenses, including reasonable legal fees, arising from your unlawful use of the Site or your material violation of these Terms.
We may limit, suspend, or terminate your access to the Site or your account if we reasonably determine that you have violated these Terms, used the Site unlawfully or fraudulently, interfered with Site security or operation, or created a risk of harm to DKMA Fragrances or another person.
Termination of access does not eliminate obligations or liabilities that arose before termination.
Provisions that by their nature are intended to survive termination—including provisions relating to intellectual property, payment obligations, limitation of liability, indemnity, and dispute resolution—will continue to apply as appropriate.
These Terms and Conditions are governed by the laws of the State of Illinois, without limiting any mandatory consumer rights that may apply under the laws of another jurisdiction.
Subject to the exceptions below, if you and DKMA Fragrances LLC are unable to resolve a dispute through informal discussion, you and DKMA Fragrances LLC agree to submit the dispute to mediation before pursuing other available remedies.
The mediator must be a neutral party acceptable to both you and DKMA Fragrances LLC. Mediation will be non-binding.
The costs of mediation will be paid by the unsuccessful party.
Nothing in this section prevents either party from bringing an eligible action in small claims court or seeking injunctive relief or relief relating to intellectual property infringement.
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue in full force and effect.
If DKMA Fragrances does not immediately exercise or enforce a right or provision under these Terms, that does not constitute a waiver of that right or provision.
These Terms, together with any policies or additional terms expressly incorporated by reference—including applicable Shipping & Delivery, Returns & Exchanges, Privacy, promotional, or service-specific terms—constitute the agreement governing your use of the Site and applicable purchases or services.
They supersede prior versions of these Terms relating to the same subject matter, except for separate written agreements entered into directly between you and DKMA Fragrances.
We may update these Terms from time to time to reflect changes in applicable law, our Site, our products or services, or the way DKMA Fragrances operates.
The most current version will be posted on the Site with its applicable effective or revision date.
When appropriate, we may also provide notice of material changes through the Site, email, or another reasonable method.
Your continued use of the Site after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
